NEW DELHI: SC Tuesday refused to entertain former Delhi mayor Farhad Suri’s plea for an FIR against UP police for conducting a midnight raid at his city home in search of journalist and Ram temple donation pilferage whistleblower Abhishek Upadhyay.Suri’s counsel, Anoop Awasthi, told SC that a Ghaziabad police team had raided Suri’s Nizamuddin East residence on the night of Aug 22 without disclosing warrants and corresponding entries at Nizamuddin police station. He urged the CJI Surya Kant-led bench to lay down guidelines for the police department of a state conducting midnight raids in another state.

UP additional advocate general Sharan Dev Singh Thakur said Suri’s petition was an abuse of the process of law and “unnecessary sensationalisation” as police merely rang the bell to find out whether Upadhyay, who was wanted in a road rage case in Ghaziabad, was available at his place. They left after Suri denied Upadhyay’s presence, Thakur said, adding that Suri could approach senior police officers for registration of an FIR and, if dissatisfied, he could move a trial court with a private complaint against police.As Suri wanted the FIR to be lodged in Delhi, the bench disposed of his petition by giving him liberty to approach the Nizamuddin police station for filing a complaint against the officers who raided his home unauthorisedly. SC had on Aug 25 protected Upadhyay against arrest by Ghaziabad police. tnn
